雨。台風崩れの雨。崩れてくれてありがたい。朝家事は掃除機がけ。エアコンのフィルター掃除。昼飯の温め。
その後、借りている『法学教室10月号』の判例セレクトの「退職手当全部支給制限処分が裁量権の逸脱濫用ではないとされた事例」を読んでみた。
27年勤めた地方公務員さんが酔っ払い運転で物損事故を起こし、懲戒免職と退職金の全部不支給の処分を受け、これを不服として訴え、高裁は首はクビにしたが、退職金は一部不支給とした。上告された最高裁は、全部不支給と判決。
以前読んだ判例と大きくは違わないようだ。

この種の話を読むと“危なかったなあ”と我が身を振り返る。曽野綾子の随筆の中に「年寄りの特徴として、運だ！運だ！が多くなる」ということが書いてあったが、運が良かった。
退職金を担保に共済から住宅ローンを借りていれば住むところも失い、家族共々悲惨というしか言いようのない状況に陥るのであろう。
豊かではないが、振り返って「あの事さえなかったら」という悔いが残らなかったのはありがたい。運が良かった。
昼飯を喰って、一息入れて、雨のため散歩には出かけず、書き取りに励む。来週の集中英聴の課題は、

I guess most of us have experienced cold calling at some time or other. We hear someone on their phones clearly working for script, saying “hello”, “how are you today?” or some such. Then they say things like “I’m calling because we have a fantastic offer that, I think, really interest you.” Or they go for a question like, “Are you happy with your broad band or are problems?” In that tiny moment, they hope they have a key that will unlock your direct debt setup. It's not fraud, but involves strategy through language to get you to ???(1)??? money. Now think a something more personal and more serious. What's known as romance fraud. A fraudster creates a situation in which the victim thinks they are being loved once hand over money to the fraudster. How do they manage to do it? What kind of script do they seem to work of. Dr Elisabeth Carter is a seniors lecturer in criminology at University of Roehampton. And she joins me today.

Now, you looked into this area of romance fraud. Why did you get interested in it? And why ???(1)??? matters?

I’m originally a linguist. I started at University of Essex and then moved into criminology and since I myself in a position of being as a linguist, which at the time was relatively new academic discipline, ???(1)??? linguists interested in all aspects, as intersection of language and law. And for me, there is no better place to study than ???(2)??? interaction, which is really be use of language to try and fraud someone and try and commit criminal act. ???(3)??? research on ???(4)??? interaction usually the research ???(5)??? concentrate on what makes victims so vulnerable, but what I’m interested in really is ???(6)??? not victims vulnerability what they’re doing to make themselves vulnerable, but what if the criminals doing, what the fraudsters doing to make themselves so persuasive so manipulative without ringing alarm bells to the victims.
